Terms and Conditions

DEFINITIONS 

Force Majeure Event: means an event, circumstance or cause beyond a party's reasonable control which includes (but is not limited to) death, epidemic, pandemic, natural disasters or war. 

Videographer: means Max Schuett of Rudimentary Studios Ltd (company number 13825074). 

Video/Film/Photograph(y): refers to all image capture and used interchangeably in reference to capture of the wedding/corporate films. 

1. PAYMENT REQUIREMENTS 

1.1 Videographer will provide services to the Client(s), providing the Client(s) have/has assessed all the risks that may occur. 

1.2 For weddings, a deposit of £150 is to be paid upon booking agreement with Rudimentary Studios Ltd.

1.3 For services, a deposit of 15% is required upon booking agreement with Rudimentary Studios Ltd unless stated otherwise when arranging the booking.

1.4 The full balance is payable at least 28 days prior to the date of the service unless otherwise stated when arranging the booking. 

1.5 Failure to pay the final balance within this period will cancel your booking and the full price agreed will become chargeable in accordance with Clause 2.3. 

1.6 All packages include travel expenses up to 60 miles from my studio (TS6). For distances greater than this I reserve the right to charge a fee for any further travel expenses. For commissions beyond 80 miles from my studio (TS6) accommodation fees will be charged for the night of the wedding and the night prior to the wedding. 

1.7 Max Schuett will be the only official videographer present on the day, except in accordance with Clause 2.1. 

2. CANCELLATION 

2.1 If the videographer has to cancel or is unable to photograph for reasons beyond their control (“Force Majeure Event”), a suitable videographer  specifically chosen by the videographer with similar photographic style and quality would be in place to photograph the subejct matter. The videographer would then edit all the photos and provide the same level or service and quality in all picture book products originally offered. 

2.2 If the client(s) changes the date for any reason, clause 2.3 applies. However, if the videographer  is available on the new date, providing this is within 6 months from the original date the retainer fee can be transferred to the new date. If this date is beyond 6 months clause 2.3 applies and the cancelation will end my liabilities. If the clients wish to use my services past this 6 month timeframe a new contract and retainer fee are required. 

2.3 In the event of cancellation by the client, all monies paid in for the photography services are non-refundable. Retainer fees are non-refundable and considered as liquidated damages. 

2.4 After a period of 14 days from the date of completing the booking form, as compensation for loss of income to the videographer the following cancellation rates apply to the client as a percentage of the total fee due based on the Gold collection price:

- 60 days or less before the shoot – 100%,

- 61 to 90 days before the shoot – 75%

- 91 to 120 days before the shoot – 50%. 

In the event of me not being able to attend due to factors such as Coronavirus illness or self isolation, clause 2.1 will apply. If you would like to cancel your contract with me in this circumstance and source your own videographer , clause 2.3 will apply. Should your date fall directly during a forced national government lockdown clause 2.2 will apply with the addition that the retainer fee can be transferred to a new date which falls within 12 months from the original date. If the clients postpone the date whilst no national government lockdown is enforced, clause 2.2 applies.

3. FILMING OF THE DAY 

3.1 Any variations in the times, dates, or to the planned event that may impact on the contract should be communicated to Max Schuett as soon as possible. 

3.2 The Client(s) must obtain permission to film and the Client(s) is also responsible for any fees levied at the various locations. The Client(s) must also seek permission from any other venue where filming will be required. Arrangements should be made for all venues to be accessible by Max Schuett at least one hour before the time of each event; this is to be arranged by the Client(s). 

3.3 I aim to be discreet whilst filming but in low light conditions additional camera-mounted or free standing lighting may be required. Coverage will be as the cameraperson’s professional expertise and no one scene will be determined more important than another. While every effort will be made to get the best position for the camera(s) to film the event this may not always be possible if restrictions are imposed upon us on the day. Max Schuett cannot guarantee coverage of any particular individual or group during the day. 

3.4 I use broadcast quality well maintained equipment, however we will not be liable for any Radio Signal losses, Battery failures, equipment failure and or material defects, which are beyond our control. In the unlikely event of a total video failure our liabilities are limited to a refund of all monies paid by the Client(s). Every effort is made to ensure perfect colour and lighting reproduction, but certain conditions may not be accurate such as mixed indoor and external lighting, hard shadows, and low lighting conditions. With these factors beyond our control, we will endeavour to produce the best image possible. In the case that a particular segment of the event is either not recorded, partially recorded, or not a part of the final edited film, it is at the sole discretion of Max Schuett. 

3.5 If something occurred on the day that the Client does not want to appear on the final film, the Client must instruct Max Schuett in writing before post production begins. Please see our previous work here to get an idea of the style of camera work and editing we typically use.

3.6 Rudimentary Studios Ltd is a videography and photography team consisting of 1 or 2 camera operatives (where deemed necessary by Max Schuett) Unless otherwise instructed we usually complete each shoot with just one videographer. The Client must provide a safe working environment and is responsible for any damage to our equipment by their guests and will be liable to pay such expenses for replacement or repairs. In restrictive conditions such as rain, extreme temperatures and humidity, adequate shelter must be provided to the Cinematographer.

4. DRONE FILMING

4.1 Drone footage is an additional extra to any package with the following conditions:

4.2 Drones cannot fly in strong winds or any kind of rain. We will endeavour to try and launch the drone at some point in the day if the usual timings, such as the drinks reception, are made impossible due to bad weather. If we are unable to take any drone footage during the day, we will refund the cost of the drone footage option. We will keep a close eye on the forecast and will let you know 48 hours before the wedding day if it looks like we are unable to fly.

4.3 It is the Client(s) responsibility to obtain permissions from the venue. We are of course  happy to liaise with them if they wish to see our CAA permission, public liability or insurance details. Please do bear in mind that even with all of these documents in place, some venues will still not allow any drones at the venue.

4.4 We will comply with all rules and regulations set out by the CAA to ensure safe flying at all times, including but not limited to safe distances from all people and buildings and the drone cannot fly directly overhead of a mass group of people for safety reasons.

4.5 If for any reason we feel that it is unsafe to fly on the day, our decision is final and we will refund the cost of the drone footage option. 

4.6 Shots will be taken of the venue at a suitable time. If any other shots are requested, we must be made aware of this before the wedding day.

5. FOOD If video coverage is greater than 8 hours, the Client must provide a hot meal or time to get one. It is very important that this be served at the same time as any other food is served to guests/crew/talent. Vendor meals provided at any other time may affect what footage we are able to capture.

6. THE EDIT 

6.1 Videographer will endeavor to build the film around any special requests made, but such requests are not binding instructions. Artistic interpretation cannot be guaranteed but every attempt will be made to comply with the Client(s) wishes. 

6.2 Videographer will not be held responsible for scenes not included due to inclement weather or other conditions outside of Max Schuett’s control. Any final editing decisions are of the sole discretion of Max Schuett. 

6.3 TWO revisions are included in the package, any further revisions will be charged at £60 per hour.

6.4 For Weddings the main wedding film will be targeted at a minimum of 1 hour total length, subject to length of wedding day coverage. The trailer version will be targeted at roughly 1 minute and no more than 2 minutes depending on requirements set by the Client. 

7. LICENCES 

7.1 To comply with Copyright law, if a choir or musician performs any music live, then a license needs to be obtained from the Composer and Publisher of the music (Legislation Copyright Designs and Patents Act 1988 Part II, s.181 et). Composers and Publishers are represented in the UK and Ireland by MCPS. If the music is being played from a CD, record or any other recording, a second license needs to be obtained from the Record Company. 

7.2 For Weddings, music used in the films will be from the North East Wedding Pianist selection provided previously by the Fusco Media which comprises of a number of acoustic covers of poplar songs played on piano. Songs chosen will be chosen by Max Schuett using their artistic interpretation. Song changes can be requested by the Client or the wedding couple and swapped out in line with clause 4.3. 

7.3 Any music requests where copyrighted music is to be used then this is to be done so in-line with Fair Use and for personal use of the couple ONLY and it will not be added to the trailer version of the video as this is intended for social media where copyright fair use does not apply. IF it is found that a version of the full wedding film with copyrighted music is posted or played in such a way that Fair Use is breached, Rudimentary Studios is not liable for any and all consequences of the breach. 

8. ACCEPTANCE OF GOODS 

8.1 The Client(s) shall within seven days from the delivery of goods give written notice to the Company of any respect in which it is alleged that the Goods do not comply with the contract. Subject to any such notice, the goods will be deemed to comply with the contract in all respects. 

8.2 I keep a master copy of the films in my archives for up to one year. All working footage is deleted after 6 months.

8.3 Unless stated in this contract Max Schuett retains Copyright of the goods produced from this contract and are protected by the Copyright and Design act 1988. The Client(s) hereby allows Max Schuett to display any media included in this contract in any form. 

8.4 Any complaints should first be raised by the Client with the Photographer/s in writing within 14 days from the date of receipt of films. In the unlikely event of an unresolved complaint, the Client may request the use of a third party, at the clients expense, to mediate but only on the basis that its decision shall be final and binding upon both parties. 

8.5 We do not offer refunds however we will do our best work with you in an effort to find a solution where reasonable concerns are raised in regards to all of the above.
